The app is licensed to you under Apple's Licensed Application End User License Agreement (the "Standard EULA"), as supplemented by these Terms. If anything in these Terms conflicts with the Standard EULA, the Standard EULA controls with respect to its subject matter.
1. License
We grant you a limited, non-exclusive, non-transferable, revocable license to download and use the app for your personal, non-commercial entertainment on Apple-branded devices that you own or control, as permitted by the App Store Terms of Service and the Standard EULA.
2. In-app purchases and virtual items
- The app offers optional in-app purchases, including consumable virtual items such as "revive coins." All purchases are processed by Apple and are subject to the App Store Terms of Service.
- Virtual coins, skins, and other in-game items have no monetary value, are not real currency, cannot be redeemed for cash, and are not transferable outside the app.
- Consumable purchases are generally final and non-refundable, except as required by applicable law or by Apple's refund policies. Refund requests are handled by Apple.
- We may, from time to time, modify, add, or discontinue in-game items, pricing, or features.
3. Acceptable use
You agree not to reverse engineer, decompile, modify, or create derivative works of the app except to the extent permitted by law; not to use cheats, exploits, automation, or unauthorized third-party software to manipulate the app or its leaderboards; and not to use the app for any unlawful purpose.
4. Leaderboards
If you use Game Center leaderboards, you agree to compete fairly. We may remove scores or restrict access to leaderboards that we reasonably believe were obtained through cheating, tampering, or violation of these Terms. Game Center is operated by Apple and is subject to Apple's terms and privacy policy.
5. Intellectual property
The app and all of its content, including graphics, audio, code, and the "Log Rush" name and logo, are owned by Vynadex LLC and are protected by intellectual-property laws. These Terms do not grant you any ownership rights in the app.
6. Disclaimer of warranties
To the maximum extent permitted by law, the app is provided "as is" and "as available," without warranties of any kind, whether express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the app will be uninterrupted, error-free, or free of harmful components.
7. Limitation of liability
To the maximum extent permitted by law, Vynadex LLC will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of data, profits, or goodwill, arising out of or related to your use of (or inability to use) the app. Our total liability for any claim relating to the app will not exceed the amount you paid to us (if any) for the app or the relevant in-app purchase in the twelve months preceding the claim.
8. Apple-specific terms
You acknowledge and agree that:
- These Terms are between you and Vynadex LLC only, and not with Apple. Apple is not responsible for the app or its content.
- Apple has no obligation to furnish any maintenance or support services for the app.
- In the event the app fails to conform to any applicable warranty, you may notify Apple, and Apple may refund the purchase price (if any) for the app; to the maximum extent permitted by law, Apple has no other warranty obligation with respect to the app.
- Apple is not responsible for addressing any claims by you or any third party relating to the app or your possession and use of it, including product-liability claims, claims that the app fails to conform to any legal or regulatory requirement, and claims arising under consumer-protection, privacy, or similar legislation. Vynadex LLC, not Apple, is responsible for the app.
- In the event of any third-party claim that the app or your use of it infringes that third party's intellectual-property rights, Vynadex LLC, not Apple, is responsible for the investigation, defense, settlement, and discharge of such a claim.
- You represent that you are not located in a country subject to a U.S. Government embargo (or designated as "terrorist supporting") and that you are not on any U.S. Government list of prohibited or restricted parties.
- Apple and its subsidiaries are third-party beneficiaries of these Terms, and upon your acceptance Apple has the right (and is deemed to have accepted the right) to enforce these Terms against you as a third-party beneficiary.
9. Changes to these Terms
We may update these Terms from time to time. Updated Terms will be posted at this URL with a revised effective date. Your continued use of the app after changes take effect constitutes acceptance of the updated Terms.
10. Governing law
These Terms are governed by the laws applicable where Vynadex LLC is established, except where mandatory consumer-protection laws in your country or region of residence provide otherwise. Nothing in these Terms limits any statutory consumer rights that cannot be waived by agreement. This section does not override the App Store Terms of Service or Apple's Standard EULA, each of which governs its own subject matter.
