Terms of Use for All That Blurs
These Terms of Use ("Terms") are an agreement between you and Vynadex LLC ("we", "us") for the mobile game All That Blurs (the "Game"). They supplement Apple's Licensed Application End User License Agreement (the "Standard EULA"), which also applies. If these Terms and the Standard EULA conflict, the Standard EULA controls to the extent required. By using the Game you accept these Terms.
License
We grant you a personal, non-exclusive, non-transferable, revocable license to download and use the Game on Apple devices you own or control, as permitted by the Usage Rules in the App Store Terms of Service. You may not copy, modify, distribute, sell, rent, reverse engineer or create derivative works of the Game, except as the law expressly permits.
Just a game
All That Blurs is a stylized arcade game. Its roads, vehicles and events are stylised and are not driving instruction. Never use your device while driving a real vehicle.
Acceptable use
Do not use cheats, exploits or modified versions of the Game, and do not interfere with the Game's normal operation.
Leaderboards and fair play
If you are signed in to Game Center, your Quick Drive distances are posted to a Game Center leaderboard. Game Center is provided by Apple under Apple's own terms, and we do not guarantee that it or the leaderboard will always be available. Scores that appear to come from cheats, exploits or modified versions of the Game may be removed.
Optional purchases and Blur Coins
The Game offers optional consumable Blur Coin packs and separate non-consumable vehicle purchases. The App Store confirmation shows the current localized price. Purchases require Apple's approval and verification. A pending purchase has not yet been delivered. Restore can recover eligible vehicle ownership for the purchasing Apple Account; it does not replenish spent coins. Apple handles billing, refund requests and purchase restrictions. Refunded or revoked purchases may lose their benefits.
Blur Coins are game content with no cash value, cash redemption or transfer to other players. A repair spends the displayed amount to continue an eligible run; buying coins does not automatically repair a crash. Offline spending is limited to credit available to that device and is recorded for reconciliation when it reconnects. Sync, device transfer and balance availability depend on the same iCloud account, retained records and successful verification. Keep devices connected long enough to sync before replacing or removing them. Vehicles use the compatible routes and skills shown in the Garage; different vehicles are not guaranteed access to every Road Trip or Contract.
Intellectual property
The Game and all of its content, including its code, artwork, sounds and the All That Blurs name, are owned by Vynadex LLC or its licensors and are protected by intellectual-property laws.
Disclaimer of warranties
To the maximum extent permitted by law, the Game is provided "as is" and "as available", without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose and non-infringement. We do not warrant that the Game will be uninterrupted or error-free.
Limitation of liability
To the maximum extent permitted by law, Vynadex LLC will not be liable for any indirect, incidental, special, consequential or punitive damages, or any loss of data or progress, arising from your use of the Game. Our total liability for any claim relating to the Game will not exceed the amount you paid for the Game, if any. Some jurisdictions do not allow these limitations, so they may not apply to you.
Terms required by Apple
- These Terms are between you and Vynadex LLC only, not Apple Inc. ("Apple"). Vynadex LLC, not Apple, is solely responsible for the Game and its content.
- Apple has no obligation to provide maintenance or support services for the Game.
- If the Game fails to conform to any applicable warranty, you may notify Apple and Apple will refund the purchase price (if any). To the maximum extent permitted by law, Apple has no other warranty obligation with respect to the Game.
- Vynadex LLC, not Apple, is responsible for addressing any claims by you or a third party relating to the Game, including product-liability claims, claims that the Game fails to conform to legal or regulatory requirements, and claims under consumer-protection, privacy or similar laws.
- If a third party claims that the Game or your possession and use of it infringes that party's intellectual-property rights, Vynadex LLC, not Apple, is responsible for the investigation, defence, settlement and discharge of that claim.
- You represent that you are not located in a country subject to a U.S. Government embargo or designated as a "terrorist supporting" country, and that you are not on any U.S. Government list of prohibited or restricted parties.
- Apple and its subsidiaries are third-party beneficiaries of these Terms, and once you accept them Apple may enforce them against you as a third-party beneficiary.
Changes
We may update these Terms. The updated version will be posted at this URL and in the Game with a new effective date. Continuing to use the Game after a change means you accept the updated Terms.
Governing law
These Terms are governed by the laws that apply to Vynadex LLC, without regard to conflict-of-law rules, except where the law of your place of residence requires otherwise.
